Appeal Court affirms election of Datti as Kano NNPP Rep

The Court of Appeal sitting in Abuja on Monday affirmed the electoral victory of Kura, Madobi, and Garun Malam federal constituency representative, of Kano State, Yusuf Datti of the NNPP.

SOLACEBASE reports that the appellate court nullified the election tribunal judgment that gave victory to Musa Ilyasu Kwankwaso of the APC.

The three-man panel led by Justice Tunde Oyebamiji Awotoye held that Datti’s appeal had merit and allowed it.

The panel further averred that the tribunal was wrong to have counted the date of the appellant’s resignation on the date of his party primary, adding that Section 77 of the Electoral Act was misapplied as the issue of membership of a political party is an internal affair, which no court has jurisdiction on.

It could be recalled that INEC had declared Yusuf Datti the winner of the election which Musa Ilyasu Kwankwaso was dissatisfied and went to the tribunal to challenge the victory.
