Appeal Court nullifies Kano tribunal judgment on Reps election

The Abuja Division of the Court of Appeal on Wednesday nullified the judgment of the Kano National and State House of Assemblies tribunal that gave victory of Kumbotso Federal Constituency election to Mannir Babba Danagudi of the APC.

SOLACEBASE recalled that the NNPP candidate, Idris Dankawu was declared by INEC as the winner of the February 2023 House of Representatives election representing Kumbotso Federal Constituency

However, not satisfied with the verdict, APC candidate, Mannir Babba Danagudi approached the election petition tribunal with a petition to nullify the electoral victory.

The election petition tribunal in its judgement sacked Idris Dankawu from the seat on the ground of certificate forgery.

The NNPP candidate dissatisfied with the tribunal judgment proceeded to the court of appeal to contest the judgement.

On Wednesday, a three-member panel of the Appeal Court , led by Justice Tunji Oyebamuji, delivered a judgement, asserting that the lower court erred in law by prioritizing the judgment on Idris Kawu’s certificate, despite the appellant not submitting same to the Independent National Electoral Commission (INEC).

Similarly, the appellate court ruled that the lower court had erred by relying on subpoenaed witnesses to give judgment.

Justice Oyebamuji asserted that Mannir Babba Danagudi had failed to provide reliable and credible witnesses to justify the annulment of Idris Dankawu’s victory in the Kumbotso Federal Constituency Election.
