INEC Guber List: Abacha drags Sadiq Wali, INEC, 2 others to court

A Kano Peoples Democratic Party (PDP) factional governorship candidate, Muhammad Sani Abacha has dragged Independent National Electoral Commission (INEC), Sadiq Aminu Wali , PDP and Shehu Wada Sagagi before a Federal High Court in Kano.

Solacebase reports that in a concurrent originating summon filed on Thursday, the plaintiff, Mohammed Sani Abacha is asking to be declared as the Kano governorship candidate of the PDP and validate the primary election that produced him monitored by the first defendant, INEC.

The plaintiff is asking the court to order for the substitution of the name of Sadiq Aminu Wali whom INEC published as the Kano PDP governorship candidate with the argument that, the primary election conducted on May 25th, 2022 under the state party leadership of the 4th defendant, Shehu Wada Sagagi was in compliance with  provision of section 84 (1) & (5) (b) (i) & (ii) of the Electoral Act 2022 and so his name ought to be published by the first defendant, INEC, as the candidate of the third defendant, PDP.

Similarly, the plaintiff is seeking an injunction restraining the first defendant, its officers, agents or privies from recognizing the second defendant or any other persons apart from the plaintiff as the authentic and lawful gubernatorial candidate of the third defendant in Kano State for the 2023 governorship election.

Recalls that on July 22nd , 2022, Independent National Electoral Commission, INEC, published the name of Sadiq Aminu Wali, as the Kano  PDP governorship candidate.

Although, the Independent National Electoral Commission (INEC) at a news conference in Kano on July 1st, 2022 said that the Commission recognized the PDP governorship primary election that produced Muhammad Abacha.

Solacebase had reported that the two contending contestants, Muhammad Abacha and Sadiq Wali emerged winners of two Parallel PDP Primaries in Kano with each of them claiming to be the authentic Gubernatorial Candidate of the Party in the State.

While answering questions from reporters, the Kano INEC Resident Electoral Commissioner, Professor Risque Shehu, said that as far as the commission is concerned the elections conducted by Shehu Sagagi led PDP group is the authentic elections because he was recognized by the law.

Professor Risque Shehu said, “as at the time the PDP Primary was conducted, Shehu Sagagi was the one recognized by the Law as the State Chairman of the Party in Kano and is also the only elections that we send our staff to monitor”.

The Counsel to the, plaintiff, Barr. Saeed Mohammed Tudun-Wada with the suit number, FHC/KN/CS/204/2022, told Solacebase that he has confidence in the court that the wrong done to his client would be redress.

The date for the commencement of the case is yet to be fixed.
