Sheikh Abduljabar Nasir Crisis: ‘’Kano state govt.’s planned dialogue is illegal”-Lawyer

Kano State Government planned dialogue and debate on the issue of Sheikh Abduljabar Sheikh Nasir and other Islamic scholars is a violation of existing court order, said a Lawyer.

A private legal practitioner, Barr. Maruf Yakasai in an interview with Solacebase on Wednesday said there is an existing court order barring the cleric from further preaching

Solacebase reports that the order was granted by a Kano Chief Magistrate Court sequel to an oral application by the applicant Counsel, Barr. Wada A. Wada from the office of the Attorney General of State.

Recalls that Kano State government had on Wednesday night debarred  Sheikh Abduljabar Sheikh Nasir Kabara from preaching in the state for his mode of teachings considered too incendiary.

However, the embattled cleric subsequently requested for dialogue or debate with other Islamic Clerics to argue his position on the religion which he believed is misunderstood.

The governor, Dr Abdullahi Umar Ganduje later accepted that and promised to work out a date.

Barr. Maruf Yakasai said once a matter is before the court any position taken is subjudice , therefore if the party concern or any other party in the suit would take any action, they should first go back to the court.

‘’Even if a dialogue is to take place or whatever, the parties would need to go back to the court with an application which the court would now assess and if granted the court would set the rules of settlement or as it may be, ‘’said Barr. Yakasai.

‘’Hence since the Attorney General of the state is the person prosecuting the case, he is expected to go back to the court with an application seeking for the dialogue and the defendant would be in court also, for the court to then look at the merit of the application’’.

‘’The dialogue cannot take place without the parties going back to the court and if it does happen is completely a violation of the court order.’’

Barr. Maruf Yakasai who noted that he has prepared a court process to challenge the matter, issued the parties 24 hours ultimatum to take the position or be drag to court.

He added that Kano has a law on blasphemy but does not have a law on insulting or defaming the companions of the prophet, therefore he is pushing for legislative action by joining the Speaker and the state assembly in the suit so that there would be specific legislation on that, similar to that of blasphemy.

‘’This would allow anybody that commit such offence to be prosecuted in Kano’’.
