Buhari’s Aide Vows To Reclaim Mandate Through Appeal Court

All Progressive Congress APC  Candidate for Kano Municipal Federal Constituency in forthcoming general elections sacked by a Federal High Court, Sha’aban Ibrahim Sharada has vowed to reclaim its mandate at the Court of Appeal.

Sha’aban Ibrahim Sharada, President Muhammadu Buhari Personal Assistant on Broadcast Media insisted that nullification of his primary election victory by the court in favour of Muhktar Ishaq Yakasai would be challenged and reclaim at the Court of Appeal.

Solacebase recalled that a Federal High Court sitting in Kano had on Tuesday nullified  Sha’aban Ibrahim Sharada candidature of the APC in the last primary election into the Kano Municipal Federal Constituency , ordering INEC to recognize  Muhktar Ishaq Yakasai as the duly elected flag bearer of the party at the forth coming  general elections.

Speaking to Solacebase on Tuesday evening  , Sha’aban Ibrahim Sharada through his Counsel, Barrister Nuraini Jimoh who expressed dissatisfaction over the judgment expressed confidence that the mandate of his client will be restored  by the  Appeal Court with so many grounds of appeals he intends to put forward.

“Muhktar Ishaq Yakasai in the four letters attached to his papers at the court confirmed that he was aware of the substitution made of his name.

“The report of the Appeal Committee of the party that also dismissed Muhktar Ishaq Yakasai Appeal and upheld the victory of my client (Sha’aban Ibraim Sharada) was tendered by us but the court refused ours but accepted that of the Plaintiff, Mukhtar Ishaq Yakasai.”

According to Barrister Nuraini Jimoh,”the plaintiff filed the case out of order as the law stipulated that the case must be filed within 14 days from the declaration of result and the plaintiff filed the papers on 29th October which was out of place.

Also , he noted that, the same plaintiff similarly filed another suit on the same issue at a High Court in Abuja on the 15th October which in law , is an abuse of court process. The counsel, said , seeing the situation the , the plaintiff quickly withdrew the Abuja.

This were arguments the court rejected and so many others, said  Barr, Jimoh.

The Counsel similarly advanced that the 7 member committee constituted by the APC National Working Committee with Mr Felix Mogbogo as Secretary submitted a report that affirmed that Sha’aban Ibrahim Sharada fulfiled the criteria to emerge as the party flag bearer of the pary ,but the report was jettisoned and that of the State Congress was adopted .

Jimoh added that this , an action contradict section 14 on the guide lines of the party in the conduct of primaries.
