Contempt: Court summons Kano CP, Attorney General, others over Muhuyi Rimingado

The Abuja Division of the National Industrial Court of Nigeria on Wednesday granted an order of committal for contempt against the Kano State Commissioner of Police Mamman Dauda, Attorney General of the State M.A Lawan, the clerk of the state House of Assembly Garba Gezawa and the acting chairman of Kano State Public Complaints and Anticorruption Commission Mahmoud Balarabe.

The order follows a motion for committal brought against them by the embattled anticorruption crusader, Muhuyi Magaji Rimingado, accusing the defendants of disobedience to the valid and subsisting judgement he secured against them.

While considering the motion, the presiding Judge Justice O.O. Oyewumi ruled that it is on the record that his court had delivered a judgement on December 14, 2022, which Mr Rimingado complained that the respondents had failed to comply with.

He further noted that the records of court equally evince that the respondents were served with the motion filed by the claimant/applicant on 24/1/2023 and 26/1/2023 respectively yet they have all failed or refused to react to it.

“It is obvious that their action to disobey the order/ judgement of this court is a deliberate act, to bring to disrepute this court of law,” the court rules.

“This court will not allow this, it is in view of this I make an order summoning the appearance of the clerk of Kano State House of Assembly Garba Bako Gezawa, the Hon. Attorney General and Commissioner for Justice Kano State M A Lawal, the 5th respondent Mahmoud Balarabe Esq and the 6th respondent Kano State Commissioner of Police Mamman Dauda to appear before this court personally on 7th March 2023 unfailingly.”

It could be recalled that the National industrial court had declared Mr Rimingado as the substantive chairman of the Kano State Public Complaints and Anticorruption Commission and ordered Governor Abdullahi Ganduje to pay his salary arrears of N5.7 million and to subsequently receive his monthly payment of salary.
