Court Dismisses Suit Against Kano PDP Governorship Candidate

A Kano High Court on Monday struck out a suit challenging the candidacy of the Governorship Candidate of the Peoples Democratic Party in Kano Abba Kabir Yusuf.

The suit was filed by a PDP Aspirant Jafar Sani Bello requesting the court to nullify the party primaries that produced Abba Kabir Yusuf as the governorship candidate of the PDP.

The plaintiff ,Jafar Sani Bello through his counsel, Abdul Adamu Fagge told the court that Abba Kabir Yusuf did not fulfil the requirement of being the party flagbearer in the forthcoming general elections.

Barrister Abdul Adamu Fagge said since his client came second in the primaries , he should be given the right to represent the party as Abba Kabir Yusuf did not fulfil the criteria to contest.

However, Counsel to the first defendant , Barrister Bashir Yusuf Muhammad requested the court to strike out the suit as it lack jurisdiction to hear case.

In his ruling on Monday , the presiding judge, Justice AT Badamosi while striking out the case said the Plaintiff Counsel filing of the process of the suit was faulty.

Responding to Journalists after the judgement, the lawyer of the first defendant Barrister Bashir Yusuf Muhammad of Maigari Partners said the verdict does not come as a surprise considering the facts presented before the court.

Also  the Plaintiff Counsel Abdul Adamu Fagge said they would study the judgement with is client and take a decision

Meanwhile, the PDP flag bearer Engr. Abba Kabir Yusuf  called on all supporters of the party to come together for the victory of PDP in all positions come 2019.

In a statement signed by the candidate’s spokesperson, Mr Sanusi Bature Dawakin-Tofa said the judgment has proven the right decision of the PDP delegates in Kano who massively voted for Engr. Abba Kabir Yusuf as popular candidate capable of transforming Kano into an economically viable State.
