DSS Shun Kano High Court, After Violation Of Order

A High Court  sitting in Kano has adjourned a contempt case against the Department of State Services (DSS) to 13 July, 2018.

The case between Alhaji Ibrahim Talle as the plaintiff and Rakiya Sa’idu  as the  defendant bothers on the ownership of a shop whereby DSS claimed to be acting on a Bichi Division High Court order obtained by the plaintiff to eject those occupying the shop.

The Judge, Justice Farouk Lawan Adamu at the Court proceeding today said the two court order presented before him by the plaintiff Counsel, Barrister Dalhatu Shehu Usman needed to be authenticated as it bothers on violation of a court order by  the Department of State Services (DSS)

In his submission, counsel to the defendant, Barrister Abdurrazak Aikawa expressed surprise in the DSS carrying out such order.

“We want them to come and explained to the Court the violation of an order by the court, that says they should maintain status co and they went and ejected the occupants which in the first instance is not there responsibility”, said Aikawa.

On his part, Counsel to be Plaintiff, Barrister Dalhatu Shehu Usman explained that the order directing the DSS to carry out the action was issued by the high court in Bichi.

“The two orders were issued by the Bichi Division of the High Court and the Court gave the DSS power to carry out the ejection,” said Usman

The matter before the court today was contempt proceeding against the DSS for violating the court order, but the DSS were not in court neither were they represented.
