Eid Ground Demolition: Court stops Kano govt from transferring applicants’ title to Saudi firm

A Federal High Court sitting in Kano on Friday restrained Kano State Government from unlawfully alienating or transferring the title Applicants’ demolished business premises at Kofar Mata Eid Ground Kano to Saudi foreign firm or any other for any purpose whatsoever, pending the hearing of the substantive application.

SOLACEBASE reports that the Incorporated Trustees of Masallacin Eid Shop Owners and Traders Association and 55 other Applicants approached the Court, with an Exparte Application, through their counsel, Dr. Nura A. Ayagi seeking the Court to restrain Kano State Government from unlawfully transferring their title of demolished business premises at Kofar Mata Eid Ground to Saudi Foreign firm.

The eight defendants in the suit are Kano State government, Kano State Urban Planning and Development Authority (KNUPDA), Attorney General of Kano State, and Nigeria Police Force.

Others are, Assistant Inspector-General of Police Zone 1, Commissioner of Police Kano State, Nigerian Security and Civil Defence Corps, (NSCDC), Commandant, Nigerian Security and Civil Defence Corps, (NSCDC) Kano command.

Ruling on the on the exparte application, Justice Simon Amobeda after hearing Dr. Nura A Ayagi, Counsel to the applicants ordered as follows:

“That the First Respondent, ( Kano State Government) are restrained from unlawfully alienating or transferring the title to Applicants’ demolished business premises at Kofar Mata Eid Ground Kano, subject matter of this action to a Saudi Foreign Firm or any other person for any purpose whatsoever, pending the hearing and determination of the substantive application.”

That the 4th to 8th Respondents are restrained from partaking in any action intended to permanently deprive the Applicants of their title interest and their unlawfully demolished business premises in and around the Kofar Mata Eid Ground Kano, pending the hearing and determination of the substantive application.” The court ordered.

Justice Amobeda similarly ordered that the time for hearing of the application is abridged for accelerated hearing.

It also ordered that the defendants shall be served with copies of the order, Applicant’s motion on notice, along side copies of the Affidavit within five days of the order to enable the respondents to file their responses and proof of service shall be filed with the Registry of the Court.

Justice Amobe consequently adjourned the sitting to 19th July, 2023.
