A Kano High Court on Thursday ruled that the state House of Assembly does not have the power to invite , investigate or summon the governor over any alleged criminal case.
The Court presided by Justice Ahmed Tijjani Badamosi in his judgement in a case filed by the Barr. Muhammad Zubairu on behalf of a group as the plaintiff ruled that the power to investigate criminal charges is vested with the Police, EFCC and the ICPC .
Justice AT Badamosi said the Assembly by the constitution only has the power to make law and review existing law but not the power to investigate criminal matters.
After the judgment, the plaintiff Counsel, Barr. Nuraini Jimoh applauded the ruling while the defendant lawyer, Barr. Muhammad Waziri said he would consult his clients on their next line of action.
The defendant in the matter includes Kano state House of Assembly, Chairman of the investigative panel of the house, Baffa Baba Dangundi and the Attorney General of Kano state.
Solacebase recalled that a seven-man committee was set up by the Kano House of Assembly to investigate a $5m bribery allegation against governor Abdullahi Umar Ganduje by an inline newspaper, Daily Nigerian.
