JUST IN: Court reverses suspension of 5 Kano Assembly members

A Federal High Court sitting in Kano has set aside the suspension of 5 members of the Kano State House of Assembly by the speaker Abdulaziz Gafasa.

The presiding Judge, Justice Lewis Allagoa ruled that the suspension was unconstitutional, null and void, directing the Speaker and the Kano State House of Assembly to pay salaries and allowances of the suspended members.

Solacebase reports that 5 members of the Assembly Labaran Abdul Madari APC Warawa,Bello Bututu APC Rimin gado/Tofa, Isyaku PDP Gezawa, Garba Yau APC Kunci/Tsanyawa and Maje Gwangwazo PDP municipal we’re suspended on March 16 for allegations of violent conduct during debate on removing the 14th emir of kano Muhammad Sanusi on March 9.

Justice Lewis Allagoa, however, agreed with the submission of the Counsel to the  5 lawmakers, Barr.  Nuraini Jimoh that the suspension contravenes article 13 of the African Charter on people’s and human rights and section 109 of the Constitution.

Also, Counsel for the speaker and the Assembly Marcelenious N. Duru said they will appeal the judgement.

The trial judge however refused to grant 10 million naira damages against the speaker, Kano State House of assembly and the Police.
