The Kaduna division of the Court of Appeal on Wednesday dismissed an appeal filed by a former Senior Special Assistant to the President on National Assembly Matters, Abdulrahman Kawu Sumaila, challenging the judgment of a Kano Federal High Court that ordered INEC to issue Certificate of Return to Shamsudeen Dambazau.
Solacebase recalled that after the 2019 National Assembly, Abdulrahman Kawu Sumaila was issued certificate of return by INEC as winner of Takai/Sumaila Federal Constituency.
However , Shamsudden Dambazau, one of the aspirants under the APC sued , Abdulrahman Kawu Sumaila on the ground that he did not participate in the party primaries.
On October 23, Shamsudeen Dambazau filed a suit at the Federal High Court in Kano challenging the election of Kawu Sumaila.
Deleivering judgement in the suit, Justice Lewis Alagoa, ruled in favour of Shamsudeen, ordering INEC to issue him certificate of return with the withdrawal from Kawu
Dambazau is the son of a former minister of Interior Gen. Abdulrahman Dambazau (rtd)
In a unanimous decision, the court held that Kawu Sumaila’s appeal lacked merit and consequently dismissed the same without cost.
