Court adjourns PDP suit against KANSIEC for judgement

Kano State High Court Presided over by Justice Ibrahim Musa Karaye has slated 1st April 2021 for Judgement in a case filed PDP  seeking the sum of 300 million Naira damage against Kano State Independent  Electoral Commission (KANSIEC) or the alledged unlawful insertion of its logo in the ballot papers during the last Local Government Elections held in the state.

Kano Branch of Peoples Democratic Party PDP’s faction led by its Chairman, Shehu Wada Sagagi through its counsel Barrister Ibrahim Wangida approached the court seeking the interpretation of section 221 of the Constitution of Federal Republic of Nigeria 1999 as amended and section 89 of Electoral Act and section 7 sub 8 of Kano State Local Government Election Law.

The PDP is asking the court to interpret weather a candidate without being sponsored by a party can participate in an election.

He told the court that the KANSIEC unlawfully included PDP logo and symbol in the ballot papers without their interest and consent.

He argued that PDP had earlier informed KANSIEC of their intention not to participate in the election.

He prayed the court to award 300 million Naira as damage in favour of his client.

In his response counsel to Kano State Independent Electoral Commission (KANSIEC) Barrister, Ibrahim Aliyu Nassarawa filed an application seeking the court to dismiss the suit alleging that the case lacks merit.

He added that the plaintiffs did not suffer any damages stressing that the case is dead on arrival.
