Court Schedules Ruling On Emir Sanusi’s Suit Against Kano Anti- Graft Commission

A Federal High Court sitting in Kano will deliver ruling in the enforcement of fundamental human rights suit instituted by Emir of Kano Muhammad Sanusi II against Kano state public complaints and anti-corruption commission.

Solacebase recalled that the commission had in its interim report on an investigation of Kano emirate council finances , recommended the suspension of the emir pending completion of the investigation of alleged misappropriation.

In the suit counsel for the Emir, Saida Suraj SAN asked the court for enforcement of fundamental human rights granted by section 36(1) of the Constitution as the action of the commission according to the counsel amounts to a condemnation of the emir without giving him a fair hearing.

He is equally seeking for an order of the court quashing the commission’s interim report.

However, the Counsel for the public complaints and anti-corruption commission Professor Sylvester Shikyil SAN countered that the suit is not a fundamental human rights issue and that the commission is conducting an investigation based on its statutory powers.

He argued that the affidavit deposed to by one Munnir Sanusi on behalf of the emir is not competent,averring that the court lacks jurisdiction as the matter is for the National industrial court to decide.

After hear arguments of both parties, Justice Obiorah Egwuatu fixed February 20th, 2020 for ruling on the matter.
