Kano Governorship Election Tribunal Adjourns Till July 13

The Kano governorship election petition tribunal on Thursday adjourned to July 13 for ruling on applications filed before it.

At the resumed hearing today, the first respondent in the petition, Independent National Electoral Commission filed a motion on notice seeking the tribunal to set aside a contempt proceeding against the Resident Electoral Commissioner in Kano initiated by the Peoples Democratic Party.

INEC Counsel , Barr. Adedayo Adedeji said the contempt proceeding initiated by the PDP purportedly in disobedient to the order of the tribunal on May 7th is grossly incompetent.

He prayed the court to dismiss the contempt proceeding initiated  on  the Form 48 and 49 purportedly served on the Resident Electoral Commissioner in Kano for lack of personal service of the said forms on the alleged Contemnor.

He explained that the application is predicated on the ground that the tribunal granted leave to the petitioner on May 7th  to carry out inspection in respect of the electoral materials used in the conduct of the 9th and 23rd March 2019 governorship election.

‘’This leave granted by the tribunal directed that a schedule order be drawn up for the conclusion of the inspection within a reasonable time, ‘’Barr. Adedayo Adeji argued.

He said but the Petitioner drew up a schedule order without the input of the first respondent, INEC or their Counsel.

He noted that despite INEC not been carried along,  the petitioner was accorded unhindered access to all the electoral materials used for the elections

He added that the ten days allotted the petitioner for the inspection has since lapsed.

However , in five applications filed by the Counsel to  APC Barr. Alex Iziyon  and Abdullahi Ganduje, Barr Aliyu Umar  prayed the tribunal to dismiss the petition in its entirety for lack of merit

On his part , Counsel to the Petitioner and PDP Barr. Adegboyega Awomolo said he needed time to study the filed applications

Solacebase reports that the tribunal Chairman, Justice Halima Shamaki then adjourned to July 13th for ruling on the applications.
