A Federal High Court Sitting in Kano presided by Justice Jane Inyang on Wednesday ordered Speaker, Kano State House of Assembly and 5 other Respondents to appear in court and show cause why the interim order sought by suspended Chairman of the state Public Complaints and Anti-Corruption Commission Muhuyi Magaji Rimingado not to be arrested should not be granted.
Solacebase reports that in an ex-parte order moved before the court on Wednesday by counsel to Muhuyi Magaji Rimin Gado, Barrister Muhammmad Dan,azumi said the application ex-parte seeking the court to restrain the Respondents was brought pursuant to order 2 rule 1 and section 35,35,37,41 and 42 of the Constitution of Federal Republic of Nigeria 1999 as amended and also order 26 sub (B), rule 7 of the federal High Court.
The Six Respondents in the Suit are: Speaker of the Kano State House of Assembly as the first Respondent, Kano State House of Assembly, second respondent, Kano State Attorney General and Commissioner For Justice, third Respondent, Accountant General of the State, forth, Commissioner of Police Kano State Command fifth and Inspector General of Police, sixth Respondent.
In the 44 paragraphs affidavit, duly sworn to by Zaharaddeen Magaji Rimin Gado, a son of the Applicant, praying the court to restrain the six Respondents from arresting his father pending the hearing and determination of the motion on notice.

While moving the application before the court, Barrister Dan’azumi urged the court to restrain All Respondents in the suit from arresting his client arguing that there was an existing order dated 23rd July, 2021 by Kano State High Court Presided over by Justice Sanusi Ado Ma,aji which restrained the Respondents from arresting his client.
He argued that the Respondents attempt to arrest and arraign Muhuyi Magaji before Kano Magistrate Court is flagrant disobedient to the court processes.
In her ruling, Justice Inyang upheld that all the Respondents in the case be served on notice for them to appear in court and show cause why the reliefs sought by the Applicant should not be granted against them.

The trial Judge ordered that hearing notice be served to all respondents and consequently adjourned the case to 3rd November, 2021 for the hearing of motion on notice.
