The Senate on Tuesday declined Lauretta Onochie’s nomination as a National Commissioner for the Independent National Electoral Commission, INEC.
The refusal to confirm Lauretta followed reports by the Senator Kabiru Gaya-led Senate Committee on INEC, which said her nomination breached the Federal Character principles, citing Section 14 (1) 3 of the Constitution, which states that somebody was already a Commissioner from her zone, in the person of Mrs. May Agbamuche Mbu, and the law remains clear about that.
That brings us to conflict number one: the conflict of zonal representation at INEC and how many people could come per state to represent the zone. In addressing the issue, the Senate President, Ahmed Lawan said, although it’s not constitutional, these members are representing zones and not states.
The next conflict is conventional but comes close to being constitutionally confrontational. Lawyers say the constitution provides for the appointment of at least one cabinet member from each of the 36 states in Nigeria.
But by convention, because the number of ministries are less than 36, and sometimes the President takes direct control of a key ministry, such as Petroleum Resources, some ministries are allocated more than one minister, through the provision of the ministers of State.
Still, despite the already glaringly swollen number of representatives from the state, which outnumbered the ministries, using his constitutionally given freedom of deciding what should be done in any particular situation, in some states, the President nominates two people without any worry of conflict of conscience. It is the discretion of the president to give the state of his choice more than a minister.

Conflict number three has to do with the difference between the meaning of citizenship and indigenship. One acquires the status of an indigene if he or she is a native of the place. On the other hand, citizenship is a legal status that mostly comes with some political connotations, that could range from birth, marriage to naturalization.
Depending on whether one is a citizen or an indigene, sometimes there is the fear of the onset of conflict of interest, which may come to question whether what is in a person’s best interest is not in the best interest of another person, or the organization to which that individual owes loyalty. This is where Lauretta Onochie’s problem came. Her position is being occupied by another lady, May Agbamuche, who by birth is from Delta, but by marriage from Cross Rivers, and is representing Cross Rivers at INEC. It has nothing to do with the issue of partisanship.
Onochie’s nomination was rejected by the Senate for reasons bordering on potential violation of the Federal Character Principle. It is for the simple reason of conflict of federal character and President Muhammadu Buhari is being applauded for respecting that.
The action of the Senate must have drown steam from that belief, the belief that PMB is a person of fine repute, that is widely known and extremely respected. It would amount to a moral dent and clear clash of conscience if he that preaches equity would turn round to undermine fair play.

Surely, and on daily basis, Nigeria is constantly confronting complex conflicts, but in the wisdom and magnanimity of its leaders, under the fair-mindedness of the present president, the problems are being prevailed over.
