A Magistrates’ Court sitting in Kano on Wednesday struck out misappropriation of COVID-19 palliative against Malam Kabiru Ado-Panshekara, the Chairman of Kumbotso Local Government Council.
Solacebase reports that Kano State Public Complaint and Anti-corruption Commission arraigned the Council Chairman, Kabiru Ado Panshekara for allegedly diverting the relief materials meant for people in his area to cushion the effects of the coronavirus restrictions.
According to Kano State Public Complaints and Anti-Corruption Commission, the alleged offence was contrary to section 315 of the penal code law and section 26 of Public Complaints and Anti-Corruption Law 2008 (As amended).
The commission said the Council Chairman was alleged to have distributed palliative materials to security personnel comprising the Police, DSS, Immigration etc as well as Hisbah personnel; an act which contravenes the provision of Section 22, 23 and 26 of the Kano State Public Complaints and Anti-Corruption Commission Law 2008 (as amended).
It said according to the list of beneficiaries of the palliatives those not included are: all political office holders, Civil Servants at Federal, State and Local Government, Political party Officials at ward level, traditional rulers Juma’at Mosques Imams and Pastors and Casual workers at Federal, State and Local Government.
Solacebase recalled that the council chairman, Kabiru Ado Panshekara was first arraigned on May,13,2020.
The court then adjourned the case till May 27 for mention.
At the resumed court sitting on Wednesday, the prosecuting Counsel, Barrister Rabiu Yusuf Hausawa requested to withdraw the suit after the Kano State Complaints and Anti Corruption Commission discovered that the old form for allotment of the palliative to beneficiaries has been changed and replaced with a new one that is in line with the palliative distribution guidelines.
Also, it discovered that the court does not have jurisdiction over the matter.
The counsel to the accused, Barrister Ismail Abdulazeez did not object to the withdrawal of the suit but requested that his client be exonerated of the charges.
The Presiding Judge, Magistrate Musa Ibrahim Fagge then gave an order to discontinue the case at no cost to each of the party
Magistrate Musa Ibrahim Fagge said the suit was dismissed in line with section 211 of the Administrative Criminal Act (ACJA)
