UPDATED : Again, Senator Shekarau faction floors Gov. Ganduje group in Court

A High Court of Federal Capital Territory , Abuja on Friday declared the local government congress held by the Gov. Abdullahji Ganduje faction of the All Progressive Congress (APC).in Kano,  Illegal , null and void.

The presiding judge, Justice Hamza Muazu in his ruling upheld the local government congresses of the Senator Ibrahim Shekarau faction.

Solacebase recalls that on November 30th, the court had declared the ward congresses held by the Abdullahi Ganduje faction of the party illegal, null and void.

The plaintiffs in the suit are Musa Muhammad Chola and 1,319 others and the defendants are All Progressive Congress (APC) , Mai Mala Buni, Senator John James Akpanudoedehe, Olayide Adewale Akinremi, Senator Abba Ali, Dr. Tony Macfoy, Barr. Auwalu Abdullahi, Usman Musa Kaita, Adebayo Iyaniwura and INEC.

On Thursday, the matter that was slated for judgment was stalled, with a motion brought by two of the defendants Dr. Tony Macfoy and  Barr. Auwalu Abdullahi ,to set aside the proceeding arguing that they were not heard from the beginning of the case.

The motion was argued and the matter was then adjourned till today, Friday.

In a ruling on Friday , the court said their application to set aside the proceeding was an attempt to waste the time of the court, wrong and has no bases.

Justice Muazu , on the main case, dismissed the defendants preliminary objections on jurisdiction and granted all the six relief of the plaintiffs.

The relief sought by the plaintiffs include declaration of the local government congresses conducted by the Senator Shekarau group as valid.

The court ordered that those who won the ward congresses, and local government congresses are to produce the state executives of the party.

The Chairman and Secretary of the seven man committee of the party , Dr. Tony Macfoy, Barr. Auwalu Abdullahi are to pay the plaintiffs N1m fined by the court

The plaintiffs were represented by Nuraini Jimoh, SAN, while the defendants were represented by Sule Usman, SAN, M.N. Duru and Mashood Alabelewe.

Recall that parallel congresses were held in Kano, with Abdullahi Abbas emerging chairman of the Ganduje-led group and Ahmadu Haruna Zago emerging chairman of the Shekarau-led faction.
