Appeal Court Upholds Tribunal Judgment On Kumbotso Federal Constituency

The Court of Appeal, Kaduna Division, on Friday, upheld the judgment of National and State Assembly elections Tribunal in Kano on Kumbotso Federal Constituency.

The appellate court dismissed the appeal filed by the All Progressive Congress candidate, Munir Baba Dangundi and the cross-appeal filed by the People’s Democratic Party candidate in the election, Ibrahim Umar Balla.

Solacebase recalled that the National and State Assembly elections Tribunal in Kano on September 10^th  had ordered a rerun at Tsamiya polling unit at Mariri Ward only.

However, the defendant in the suit, Munir Baba Dangundi appealed the judgment while the petitioner Umar Ballah of the Peoples Democratic Party (PDP) dissatisfied, also filed a cross-appeal praying the appellate court to declare him as the winner of the election.

Reading the lead judgment on Friday, Justice Hussaini Muktar said the appeal and the cross-appeal lacked merit.

In a related development, the Appeal Court Kaduna division has also set Monday 11th November 2019 for hearing and adoption of the brief of arguments on the Kano Guber Election Petition between Engr Abba K Yusuf, his party the PDP and Kano State Governor Abdullahi Umar Ganduje and the All Progressive Congress.

The parties in the suit were notified on Thursday by the Appeal Court.

Solacebase reports that the Appeal Court has up to 30th November 2019 to pronounce judgment on the petition. Read full story
