Court restrains Kano Assembly from investigating suspended anti-graft agency Chairman, Muhuyi Magaji

A Kano State High Court on Friday restrained the state House of Assembly from taking any further action in the ongoing House investigation on the complaints against the suspended chairman of the State Public Complaints and Anti-Corruption Commission, Muhuyi Magaji Rimingado.

Solacebase reports that the plaintiff in the suit is Muhuyi Magaji Rimingado with Kano State House of Assembly as first defendant, Attorney General of Kano State as the second defendant, Accountant General of Kano State as a third defendant and the Ad-Hoc Committee of Kano State House of Assembly as the fourth defendant.

In the interim injunction, obtained on Friday, the presiding judge, Justice Sanusi Ado Ma’aji, restrained the state assembly from continuing with its investigation pending when the court will hear the substantive matter filed by his lawyers.

Justice Sanusi Ado Ma’aji also ordered for accelerated hearing in the substantive matter and ordered that the respondents in the matter be served through the office of the attorney-general of the state.

The judge granted the order after hearing from Counsels to the plaintiff that includes, Barr. M. K Umar, Barr. U.U Fari, Barr. R.O. Zakariyya and Barr. A.A. Muhammad.

This is coming after the state house of assembly suspended the chairman of PCACC over a petition against him by the accountant-general of the state due to his rejection of the posting of an accountant to the commission.

Subsequently, the State House of Assembly had invited Mr Rimingado to appear before its ad-hoc committee investigating the petition against him on Wednesday, July 14, 2021.

According to Muhuyi’s  Lawyer, Barr Usman Umar Fari, on  July 14th Wednesday could not honour the invitation due on health grounds, in which he tendered a medical report and demanded a certified true copy of the house resolution of July 5th and the press releases from the house pronouncing his suspension with the petition against him.

With this, the State House of Assembly wrote to the National Hospital to authenticate the medical report submitted to it, in which the hospital on July 19th said the report did not emanate from the health institution.

However, on July 23rd, Muhuyi Magagi’s Lawyers wrote to his personal physician, Dr. Bayo Ayodele to clarify the medical report from the National Hospital issued him within 48 hours otherwise he would be drag to court.
